Success

Butlers is uniquely equipped to offer business and legal advice in a complete service package. Butlers offers intelligent and tough representation in a range of tribunals and courts, including the Administrative Appeals Tribunal, Supreme Court and Federal Court.

Smash Repairers dispute in the Federal Court

Butlers successfully defended the Country North Vehicle Repairers Association of NSW and others in proceedings in the Federal Court of Australia, NSW. The claim was brought by Insurance Australia Group Limited, on behalf of the National Roads and Motorists’ Association (NRMA).  The association tried to introduce punitive and oppressive trading conditions on local repairers which threatened their independence and livelihood.

Butlers Business and Law negotiated an outcome which restored the rights of the smash repair businesses and successfully concluded the matter to the benefit of their clients.

This was a high profile case, with the smaller operators taking on the might of a large and powerful organisation. At the centre of the resolution were detailed knowledge of case law and the strong mediation and negotiating skills brought to the table by Kym Butler and his team. In conducting the defence, Butlers demonstrated resourcefulness in marshalling compelling evidence, and our staff displayed intelligence, tenacity, and an enormous capacity for work.

Taxation Matters, Hearings and Rulings

Many of our clients are significant organisations which require tailored taxation and legal advice. As part of this service, Butlers has vast experience in formulating and running cases before the Administrative Appeals Tribunal to achieve positive rulings for its clients.

Butlers has a well deserved reputation for success in defending taxation cases which come before the Administrative Appeals Tribunal. Many of these cases arise out of GST disputes, an area of specialisation at Butlers Business and Law.

Our strength is in mediation with a preference to negotiate a positive commercial outcome for our clients, rather than end up in the courts.

We have acted for Banks and Building Societies as well as liquidators and insolvency firms.

On numerous occasions, Butlers has then proceeded to attain private rulings from the ATO to solidify and protect the interests of its clients. Butlers combines a considerable taxation knowledge-base with an avid attention to legal rights and responsibilities which combines to ensure that every sound avenue is explored for our client and a best possible outcome is always reached.

Significant Ongoing Client Relationships

At Butlers, we are proud of the fact that many of our clients have been with us for over 30 years. We view this as a privilege, and a testament to our emphasis on skill, discretion, and understanding our clients’ needs.

For more than 30 years Butlers has acted for a leading car dealership group in the Sydney and Hunter regions of NSW. In addition to complete care in business and tax advice, we have provided industry-specific services to this client, which have allowed it to maintain an enviable reputation and a healthy business direction. We also provide regular and tailored advice on superannuation, tax planning, business structuring, and compliance.

Butlers acts for one of the largest national self storage providers with locations in the Hunter and surrounding regions. Over the years, this business has expanded and grown admirably, and with it so have its advisory needs. We offer a complete service which is both detailed and competitive. Butlers ensures that it provides informed and reliable tax advice and legal services.

We keep all of our clients informed and prepared through regular updates on legal and business developments affecting the conduct of business in their sector.

We take pride in the successes of our corporate clients, and actively seek out ways in which to advance their interests in a robust marketplace.

Major Franchise Agreements in Hospitality and Retail

Butlers has experience assisting clients in negotiating and purchasing franchisee licenses with several multinational retail and hospitality corporations. As a matter of course, these negotiations involve significant investment of capital, reputation, and effort. Butlers recognises this investment and at all times we represent our clients’ interests with strength and integrity.

We are well-resourced to accommodate the workload of substantial business transactions, while retaining the scrupulous perspective which allows us to apply a ‘fine tooth comb’ to successfully negotiating the terms of these agreements to satisfy our clients interests.

Sale of Business

Butlers has acted for clients on the sale of businesses. This has included companies with multiple premises in the Newcastle region, complex Intellectual Property agreements, and negotiations with international purchaser companies. In each case, we apply our considerable expertise to understanding the complexities of the transaction. This might be valuation of plant and equipment and goodwill, assignment of licenses and leases, the future use of the company name or business name, assignment of trademarks and branding and domain names, or warranties and restrictions on future business actions.

Butlers recently represented the vendor in the sale of a major retailer with several outlets in the Newcastle and Hunter region. Butlers assisted its client in negotiating the terms and carried out meticulous commercial drafting of the share sale agreements.

Negotiation of CEO Employment Terms and Contract

At Butlers, we understand that everybody expects to be appropriately remunerated for their hard work and expertise. When highly qualified individuals entrust us with negotiating and securing the terms of employment in a variety of prestigious employment positions, we consider it a vital responsibility. We consider our attention to detail and dignified approach to be our hallmark in this area.

As an example, Butlers has represented the interests of a highly qualified and respected CEO in his employment negotiations with an organisation in the civil sector. In that instance, Butlers embodied our client’s needs and achieved a result in terms of position, remuneration, conditions, and entitlements. We conducted ourselves at all times in a manner which was sensitive to our clients needs and safeguarded a positive ongoing relationship with the employer. At all times, our lawyers are mindful of our client’s reputation and conduct our interpersonal exchanges with eloquence and respect.
